(Twenty of the OM TMD/101/2025

For the purposes of fulfilment of obligations with regard to advertising of subsidies granted by the OM TMD/101/2025, delegations are reminded that paragraph twenty provides as follows:

1. The entities beneficiaries will recognise the financing of the General state administration, through the ministry of Territorial policy and Democratic Memory, using the image contained in the Visual Identity or Institutional Image to be determined by the Competent organ of the General state administration in the action of advertising brought in this subparagraph.

2. From the acceptance of a project by the General directorate of Local and Regional Cooperation:

a) in all actions of advertising or publicity that local governments could not be concerned about the project or any work of the same, shall indicate that the project is funded by the General state administration, through the ministry of Territorial policy and Democratic Memory, and the financial contribution allocated.

(b) Was set up a poster on the job, or, where appropriate, modify the existing one, which report that the works are funded by the General state administration, through the ministry of Territorial policy and Democratic Memory, as well as the financial contribution allocated. The poster must remain at the project site until the justification of the grant.

3. From the commissioning of the work under financing, the beneficiary entity is to put in a visible place of the infrastructure, equipment or facility a plaque or permanent element, which report to the work has been funded by the General state administration, through the ministry of Territorial policy and Democratic Memory, and the financial contribution received. This nameplate or element must remain in the infrastructure for a period of not less than five years after their placement.

4. In all contracts or orders in the implementation of the project, the entities beneficiaries should be noted that receives funding from the General state administration, through the ministry of Territorial policy and Democratic Memory. This reference should also be included in all documents relating to the procurement proceedings or the direction of the project, including invoices.

5. The entities beneficiaries will include mechanisms to ensure that contractors or effective means to implement all publicity obligations covered by this subparagraph in the territory.

6. Default advertising measures of the grant by the beneficiary, shall be followed in the terms provided for in article 31.3 of the rules of procedure of the General law on Subsidies.

7. Not to develop dissemination, shall be deemed cause of compensation for breach of the obligations of the beneficiary entity, as provided in article 37 of the law 38/2003 of 17 november, this is without prejudice to the responsibilities that may apply for implementation of the regime envisaged in title IV of the above-mentioned law.
