Determination of the AESIA headquarters

The council of ministers has agreed to the start of the procedure for the establishment of a physical headquarters of the future Spanish Agency for monitoring the Artificial Intelligence (AESIA).
With this, spain will become the first country in the European Union with a state agency for monitoring the Artificial Intelligence (IA), anteponiéndose the entry into force of the future european regulation of IA, which establishes the need for member states can have a supervisory authority in this area.

The additional provision of the thirty-one hundredth law 22/2021, of 28 december, of general state budget for the year 2022, authorizes the government to promote an act for the creation of the spanish agency for Artificial intelligence Oversight (hereinafter, the agency).

The creation of the agency also implements as envisaged in the recovery Plan, transformation, and resilience (PRTR), 10 settlement policies that give lever to an agenda for investment and structural reforms aimed at four cross-cutting objectives: to move towards a green Spain; more digital; more cohesive social and territorial levels; and more equal.

The sixth of these policies is the pact for science and innovation, in which it sits the national strategy of Artificial Intelligence (Component 1, 16, Reform, the recovery Plan, transformation, and resilience). So that the agency can effectively contribute to the fulfilment of the targets set in the PRTR, it is advisable to a prior assignment from headquarters, to be applied taking into account these objectives.

In this way, in anticipation of the role and objectives of the agency, have been considered necessary to determination of the physical headquarters, before the creation and, of course, before its implementation, in order to build an ecosystem and a pole of attraction of innovation and talent of artificial intelligence or monitoring systems.

In accordance with article 6.1 of the royal decree 209/2022, “ the council of ministers may agree with a statement of reasons the start of the procedure before the creation of the entity ”. Under this provision, the council of ministers, at its meeting held on 13 september 2002, agreed to initiate the procedure for determining the physical headquarters of the spanish agency of Supervision of Artificial intelligence.

Moreover, the council of ministers, at its meeting on 27 september 2002 agreed to conduct this procedure through the processing of urgency, in accordance with article 6.9 of the royal decree 209/2022. The motivation to use the urgent procedure is that in its mandate as envisaged in Act no. 22/2021, of 28 december, the government is urged to promote the creation of the agency throughout this year, as well as the need for the elected village to locate the seat of health of the future agency to move forward in the work of preparation and organization requirements, with a view to ensuring its correct implementation once its establishment by law. In addition, the proposal of The european parliament and council regulation laying down harmonised rules in the field of Artificial intelligence and amending certain legislative acts of the union, is expected that the member states must select a “ national authority for monitoring ”, which should assume obligations in the short term. In addition, the early establishment of the agency will contribute to achieving the targets set in the recovery Plan, transformation and Resilience and hence of the commitments made with the european commission.

Similarly, and following articles 3.2.b) and 6.2 of the royal decree 209/2022, once the council of ministers agreed to the start of procedure for determining the physical locations of the spanish agency of supervision of Artificial Intelligence, at its meeting held on 13 september 2002, the advisory committee to the determination of the headquarters of the entities belonging to the public sector institutional adopted state, at its meeting on 29 september 2002, the report of the relationship of criteria that will be taken into account in determining the location.
