Article 6 of Law 30 / 1992 of legal regime of public administrations and the Common Administrative Procedure

Article 6. Collaboration agreements.

1. The General Administration and public agencies linked or dependent on the same may hold collaboration agreements with the corresponding organs of the administrations of the Autonomous communities in their respective areas of competence.

2. The instruments of formalization of conventions should specify, as appropriate:

to) bodies that celebrate the convention and the legal capacity with which serves each side.

(b) competition that exerts every Administration.

(c) Funding.

d) the proceedings to be agreed to develop for compliance.

e) the need or not to establish an organization for its management.

(f) the term, which does not prevent its extension as agreed by the parties to the convention.

(g) the extinction because other than anticipated in the previous section, as well as how to finish the ongoing proceedings for the course of extinction.

3. When creating a joint body of monitoring and control, It will solve the problems of interpretation and enforcement that may arise regarding the collaboration agreements.

4. When the conventions are limited to establish patterns of political orientation on the performance of each Administration in a matter of common interest or to fix the general framework and the methodology for the development of cooperation in an area of competence interface or in a matter of mutual interest as General Protocols.

5. When the management of the covenant make necessary to create a common organisation, it may take the form of a consortium with legal personality or corporation.

The statutes of the consortium will determine the purposes thereof, as well as the particularities of the organic regime, functional and financially.

Decision-making bodies be composed of representatives of all entities consorciadas, in the proportion is set in the statutes.
