INTRODUCTION TO THE MEMORY DEMOCRATIC

The 1978 constitution was based on a broad social and political commitment to overcoming the serious and deep wounds that he had suffered from the spanish society during the Civil war and forty years of dictatorship of General Franco. In this way, the recovery of freedoms and the rule of law undertaken by the democratic heritage which generations of spaniards had forged with the common goal of achieving and ensuring democratic coexistence, with respect to pluralism of the spanish society, and to achieve a social and economic order.

Since then, many political initiatives, legal, social and cultural rights have been repaired and heal those gaps to avoid divisions between citizens and to promote cohesion and solidarity among the various generations of spaniards around the highest values of our legal system, the constitutional principles and fundamental freedoms and rights

The articulation of public policies that give effect to the principles of Truth, justice, Reparation and guarantees of non-repetition are essential in building a shared democratic memory, not only overcome the wounds, but also serve as a solid basis to a genuine democratic culture.

The real turning point to the recognition of historical memory is found with the adoption of the law 52/2007 of 26 december, which recognized and expanded rights and provide for those who suffered persecution or violence during the civil war and dictatorship, known popularly as "Historical Memory act", adopted with a broad consensus. The text of the act is the result of the work of the inter-ministerial commission to study the situation of victims of the civil war and of francoism, created by Royal Decree 1891/2004 of 10 september, to study the situation of victims of the civil war and of francoism and assumes the declaration and the conviction of francoism contained in the report of the council of europe parliamentary assembly signed in paris on 17 march 2006 in the reported serious human rights violations committed in Spain between 1936 and 1975.

The Royal Decree 2/2020, of 12 january, for which they ministerial departments, first established within the ministry of the presidency, relations with the courts and Democratic Heritage the state secretariat for Democratic Heritage. For its part, the royal decree 139/2020, of 28 january, establishing the basic organizational structure of the ministerial departments, established the directorate General of Democratic Heritage attached to the Secretariat of State.

The two bodies are designed to respond and impetus to initiatives related to the law 52/2007 of 26 december, which recognized and expanded rights and establishing measures in favour of those who suffered persecution or violence during the civil war and dictatorship, and provide appropriate institutional support to the implementation of the objectives contained in the above-mentioned law.

Being the memory the exercise of reconstructing past events in the present moment, to be understood as a right;a rightof citizenship. For the basic objective of any policy of memory and of this web portal in particular is to create social pedagogy that provideguarantees of non-repetition"
